gymBuddy Terms of Service

These terms are an agreement between you and the developer of gymBuddy (“gymBuddy”, “the app”, “we”). They cover your use of the gymBuddy app and the optional gymBuddy Pro subscription.

Acceptance

By downloading or using gymBuddy you agree to these terms. If you do not agree, please do not use the app. These terms apply in addition to Apple’s Licensed Application End User License Agreement and the Apple Media Services Terms that govern your App Store purchases; if they conflict on a point Apple requires, Apple’s terms apply.

Licence

We grant you a personal, non-exclusive, non-transferable, revocable licence to use gymBuddy on Apple devices you own or control, as permitted by the App Store’s usage rules. The app is licensed to you, not sold. No account is needed to use it.

Health and Safety

gymBuddy is a fitness tool, not a medical device, and nothing in it is medical advice. Rep counts, form feedback, coaching cues, programs, and calorie estimates are produced automatically from your device’s camera and are general information only. They can be wrong, and they are no substitute for a doctor, physiotherapist, or qualified trainer.

• Talk to a doctor before starting any exercise program, especially if you are pregnant, have an injury or a medical condition, or have been inactive.
• Stop immediately and seek medical help if you feel pain, dizziness, shortness of breath, or discomfort.
• Make sure you have a clear, safe space to exercise, and that your device is placed where it cannot fall or trip you.

You exercise at your own risk. Physical exercise carries an inherent risk of injury. To the extent the law allows, you take on that risk and are responsible for deciding whether an exercise is right for you.

gymBuddy Pro Subscription

Every individual exercise in gymBuddy is free, and so is your first workout program. gymBuddy Pro is an optional auto-renewing subscription, offered monthly or yearly, that unlocks all workout programs. The price for each option is shown in the app before you buy.

• Payment is charged to your Apple ID account when you confirm the purchase.
• The subscription renews automatically for the same period and at the same price unless you cancel at least 24 hours before the end of the current period.
• Your account is charged for renewal within 24 hours before the end of the current period.
• You can manage or cancel your subscription anytime in Settings → [your name] → Subscriptions on your device. Cancelling stops future renewals; you keep access until the end of the period you have already paid for.
• If a free trial is offered, any unused part of it is forfeited when you buy a subscription.
• Deleting the app does not cancel your subscription.

Billing is handled entirely by Apple, and we never see your payment details. We cannot issue refunds ourselves: refund requests are handled by Apple at reportaproblem.apple.com. If the price of a subscription changes, Apple will tell you in advance and, where required, ask for your consent.

Acceptable Use

You agree not to:

• use gymBuddy in any way that breaks the law;
• copy, modify, reverse engineer, or redistribute the app, except where the law gives you that right;
• get around the subscription or any other technical limit in the app;
• use the app to analyse another person without their knowledge and consent.

Your Data

How gymBuddy handles data is described in the Privacy Policy. In short: video is processed on your device and is never recorded, stored, or transmitted, and your workout history stays on your device. Because it is stored only on your device, deleting the app deletes that data, and we cannot recover it for you.

Intellectual Property

gymBuddy, including its code, design, exercise programs, text, and graphics, belongs to its developer and is protected by copyright and other laws. These terms give you no rights to it beyond the licence above. Apple, the App Store, and iPhone are trademarks of Apple Inc.

Disclaimer of Warranties

gymBuddy is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that rep counts, form feedback, or calorie estimates will be accurate, that the app will be free of errors or interruptions, or that using it will lead to any particular fitness result.

Limitation of Liability

To the fullest extent the law allows, gymBuddy’s developer is not liable for any indirect, incidental, special, or consequential damages, or for any personal injury or property damage, arising from your use of the app. Our total liability for any claim relating to the app is limited to the amount you paid for gymBuddy Pro in the 12 months before the claim arose.

Nothing in these terms limits liability that cannot be limited by law, or takes away rights you have as a consumer under the laws of the country where you live.

Apple

These terms are between you and gymBuddy’s developer, not Apple. Apple is not responsible for the app or its content, has no obligation to provide maintenance or support for it, and is not responsible for handling claims relating to it. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Changes and Termination

We may update these terms as the app changes. When we do, this page will be updated and the “Last updated” date above will change. If you keep using gymBuddy after a change, you accept the updated terms.

You can stop using gymBuddy at any time by deleting it (remember to cancel any subscription first). Your licence ends automatically if you break these terms.

Governing Law

These terms are governed by the laws of Sweden, without regard to its conflict-of-law rules. This does not affect any mandatory consumer protections you have where you live.
